Court Overturns Trump’s $100,000 Fee on H-1B Visas

A federal court in the United States has struck down a $100,000 application fee imposed on new H-1B visas, ruling it unlawful. This decision marks a significant setback for the immigration policy implemented under President Donald Trump. The ruling was delivered by Judge Leo Sorokin, following a lawsuit initiated by a group of state attorneys general. Sorokin determined that the hefty fee functioned as a tax and that President Trump lacked the necessary congressional authorization to enact such a charge.

According to Judge Sorokin, the federal agencies tasked with processing H-1B visas cannot legally enforce the $100,000 fee, as it surpasses the scope of executive authority. He emphasized that this policy could potentially harm critical sectors like healthcare and education, which depend on the contributions of skilled foreign professionals. The Trump administration has expressed its intention to appeal the court’s decision, maintaining confidence that the ruling will be overturned in the future.

The H-1B visa program is crucial for U.S. employers seeking to hire highly skilled foreign workers in specialized fields. Annually, the program allocates 65,000 visas under the standard quota, with an additional 20,000 visas reserved for applicants with advanced degrees. Indian professionals constitute the majority of H-1B visa holders. Prior to the proposed fee hike, employers typically incurred several thousand dollars in processing and filing expenses. The introduction of the $100,000 fee was part of a broader strategy to reduce reliance on foreign labor and promote the hiring of American workers.

As a result of the court’s decision, the controversial fee cannot be implemented unless the ruling is reversed through the appeals process. This development underscores the ongoing legal and political debates surrounding immigration policies and their implications for both U.S. employers and foreign professionals.
